Burford Capital Ltd. surged more than 12% on Monday, marking its largest intraday increase since the end of March, after a federal jury delivered a verdict in a patent case involving Apple.

According to Zhihu Finance APP, Burford Capital Ltd. (BUR.US) rose more than 12% at one point on Monday, marking its largest intraday gain since the end of March, after a federal jury reached a verdict in a patent case involving Apple (AAPL.US). By the close, the stock had risen nearly 8%.

A federal jury in San Diego on September 25 ruled that Apple must pay more than $5.7 billion in damages for infringing patents owned by Taction Technology Inc. related to vibration-based technology. Reports indicate this is one of the largest patent verdicts in U.S. history.

The case’s discovery documents revealed that Taction was financed by Gronostaj Investments LLC and Kenosha Investments LP, the latter of which was identified in another lawsuit as an indirect subsidiary of Burford Capital Ltd.

In a statement on Monday, Burford Capital said that if the verdict amount is paid as awarded, Burford is entitled to $1.4 billion, roughly split between its balance sheet and investment funds.

Burford cautioned that this amount may change as a result of post-trial procedures and appeals. Apple has filed a motion for judgment as a matter of law, asking the trial court to set aside the jury’s verdict. The U.S. Court of Appeals for the Federal Circuit, which handles patent appeals, is known for its rigorous review of large verdicts.

The litigation funding company stated: “A jury verdict does not represent a final judgment, nor does it mean that Burford has actually received any cash proceeds. The case still faces significant litigation and collection risks.”

Burford noted that the final settlement amounts in litigation cases are often lower than the jury’s award, and the parties may agree to settle for a much lower amount. The company’s ultimate entitlement will also depend on the terms of its funding agreements, as well as applicable fees, expenses, taxes, and other deductions.
